Legally compliant? No
The allocation of site MMO006 is unsound and unjustified due to the error in CD/MIS/003 that Maids Moreton has 6 key criteria when in fact it only has 4, allowing the Settlement Hierarchy to classify Maids Moreton as a medium village when in fact it is a small village. The new allocation of 12 houses made by MM283 is adequate and proportion only if MMO006 is deleted from the VALP.
Site MMO006 must be deleted from the VALP in order to ensure the VALP is sound and legally compliant.
The allocation of site MMO006 is not justified because Maids Moreton was incorrectly categorized as a 'medium village' in the Settlement Hierarchy due to the false assertion in CD/MIS/003 that Maids Moreton has 6 key criteria when in fact it only has 4. This is set out in detail in ED228. A further allocation of 12 dwellings has now been made in MM283, which raises the total number of dwellings in Maids Moreton to 182. For a 'small' village 182 houses is vastly disproportionate to the size of the settlement. In any event, the allocation in MM283 of 12 houses alone is adequate for a medium settlement. The entire allocation of site MMO006 unsound and not legally compliant due to the inaccuracy of the Settlement Hierarchy, and MM283 is only acceptable if site MMO006 is deleted from the VALP.
