VALP Main Modifications

MM153

Representation ID: 3587

Received: 16/12/2019

Respondent: Hambledon Land

Agent: Turley Associates

Legally compliant? Not specified

Sound? Not specified

Representation Summary:

Plan should be updated to include reference to updated guidance in PPG older persons housing. Addition would be uncontroversial and would ensure a greater degree of consistency with the updated PPG against which the VALP will need to be considered once it is adopted.

In addition, and as recognised in the PPG (Paragraph: 002 Reference ID: 63-002-20190626), we consider that it would be a positive step for the VALP to refer to the wider benefits which can be provided by providing such accommodation.

Change suggested by respondent:

Plan should be updated to include reference to updated guidance in PPG older persons housing.

Representation Summary:

Whilst we support the clarification that the OAN for the District's older people as set out in the preceding table (subject to MM154) does not include the projected increase in the 75+ institutional population, we are concerned that MM155 is one of a number of Modifications proposed to the VALP which could lead to the District Council predetermining use classes for older persons' accommodation.

MM157

Representation ID: 3593

Respondent: Hambledon Land

Agent: Turley Associates

Legally compliant? Not specified

Representation Summary:

Whilst we support MM157 insofar as it acknowledges that a variety of forms of accommodation are provided to meet the differing needs of older people, we have significant concerns that this Modification could lead to the Council predetermining use classes for older persons' accommodation. AVDC is taking an outdated view as to what forms of accommodation fall into C2 and C3 Uses and involvement of the County Council's Health and Adult Social Care Services department is not required to demonstrate that a proposal has a C2 Use Class. The VALP should recognise that the market has shifted and evolved.

Change suggested by respondent:

Remove any predetermination of what amounts to a C2 use

MM158

Representation ID: 3595

Received: 16/12/2019

Respondent: Hambledon Land

Agent: Turley Associates

Legally compliant? Not specified

Sound? Not specified

Representation Summary:

We welcome the Council's recognition that some of the categories of accommodation defined as C3 in the HEDNA have been found to be C2 uses in recent appeal decisions.
Furthermore, we note that MM158 appears to count the need for the Extra Care, Sheltered 'plus'/enhanced sheltered and Dementia categories against the need for C2 accommodation.
However in order to support (rather than obstruct) the delivery of such schemes, it is essential that AVDC does not predetermine the features and characteristics that would influence whether specific proposals fall into C2 or C3 uses.

Change suggested by respondent:

The plan should not predetermine the features and characteristics that would influence whether specific proposals fall into C2 or C3 uses.

MM161

Representation ID: 3600

Received: 16/12/2019

Respondent: Hambledon Land

Agent: Turley Associates

Legally compliant? Not specified

Sound? Not specified

Representation Summary:

MM161 refers to existing completions and commitments for C2 accommodation between 2013 - 2018 of 1,130 units, resulting in a remaining requirement of 800 units of C2 accommodation to be identified between 2018 - 2033.
However, we have been unable to find any evidence to explain which sites/schemes contribute to the figure of 1,130 and so that level of supply cannot be interrogated to check if it qualifies as a C2 use. Our own research has not established anything like the supply claimed. AVDC should provide greater clarification of the forms of accommodation counted towards the 1,130 units figure.

Change suggested by respondent:

AVDC should provide greater clarification of the forms of accommodation counted towards the 1,130 units figure.

Respondent: Hambledon Land

Legally compliant? Not specified

Representation Summary:

The remaining requirement figure of 800 C2 units needs to be justified.
For consistency with other Main Modifications, the word "houses" in MM162 should be changed to units.
MM162 states that "Some of the C2 requirement may be met by mixed C2 and C3 schemes." MM162 should be amended to clarify that only C2 accommodation will be counted towards the C2 requirement.

MM165

Representation ID: 3603

Received: 16/12/2019

Respondent: Hambledon Land

Agent: Turley Associates

Legally compliant? Not specified

Sound? Not specified

Representation Summary:

The Council has calculated the capacity of sites which may be expected to provide C2 older persons accommodation between 2018 - 2023 based on an assumed density of 70 units per hectare (in less urban, more suburban and edge of settlement locations) and 100 units per hectare in more urban settings. However there is no evidence to support any form of claim that the three sites allocated by the Council will deliver the quantum of accommodation expected by AVDC by 2023.

Change suggested by respondent:

Review the capacity of allocated C2 sites
